  1. Iterated's Fractal Viewer (Macintosh) License Agreement
  2.  
  3. This License Agreement applies only to Iterated's Fractal Viewer product.
  4.  
  5. END USER AND ROYALTY FREE DISTRIBUTION LICENSE AGREEMENT
  6. REDISTRIBUTION PERMITTED ONLY IF PROGRAM AND FILES ARE NOT MODIFIED 
  7. AND ALL FILES, INCLUDING THIS FILE, ARE INCLUDED. 
  8.  
  9. GRANT: Iterated Systems, Inc. ("Iterated") hereby grants 
  10. you a limited, nontransferable, terminable, non-exclusive license 
  11. subject to the following to use its accompanying computer software 
  12. product known as the Fractal Viewer Plug-in for Netscape Navigator 
  13. (the "Software") for individual use only on a Personal 
  14. Computer described below.  You may place the Software on networks 
  15. and online systems exclusively for the purpose of allowing 
  16. downloading and copying of the Software for archival, distribution
  17. and installation purposes (but not for purposes of execution by 
  18. the network or online system) provided any such copy must contain 
  19. all of the original Software and  text files including this License 
  20. Agreement and any proprietary, license and copyright notices on 
  21. the original.  This License Agreement only applies to the Software 
  22. described above and does not grant any rights to any other Iterated 
  23. software, even if related to the Software, including any software
  24. that encodes or compresses images in any way. 
  25.  
  26. You may use the Software only on a single user Personal Computer 
  27. that: (a) has one Intel 386, 486 or Pentium processor, Motorola 
  28. 68030 or 68040 processor or IBM PowerPC processor; (b) operates 
  29. only the Microsoft DOS and Windows operating system or the Macintosh 
  30. operating system; (c) contains at least 4 megabytes of random access 
  31. memory; (d) contains 80 megabytes of internal hard disk storage; 
  32. (e) contains a keyboard (not an  infrared remote) and monitor (not 
  33. a television set); (f) is able to produce printed output on a local 
  34. printer; and (g) does not act as a server on any network (including 
  35. a local area network, wide area network or Internet) or otherwise 
  36. allow operation of the Software from a remote or separate computer 
  37. or terminal ("Personal Computer").  For the  avoidance of
  38. doubt, and without limitation of the foregoing, "Personal 
  39. Computer" does not include game players, television set-top 
  40. boxes or so-called "Internet Appliances". 
  41.  
  42. You may not permit other individuals to use, operate or copy the 
  43. Software (except as permitted above).  You may not use or allow the
  44. use of the Software on any computer or other device that is not a 
  45. Personal Computer (as defined above).  You may not modify, translate,
  46. reverse engineer, decompile, disassemble, (except to the extent 
  47. applicable laws prohibit such restriction), or create derivative 
  48. works based on the Software, copy the Software (except as specified
  49. above), rent, lease, transfer, license or otherwise transfer rights 
  50. to the Software, or remove any proprietary notices, licenses, 
  51. displays, installation procedures or labels on or in the Software, 
  52. whether set forth in text files or on media.   
  53.  
  54. DISCLAIMER OF WARRANTY: THE SOFTWARE IS LICENSED ON AN AS-IS BASIS, 
  55. WITHOUT WARRANTY OR CONDITION OF ANY KIND AND ITERATED DISCLAIMS 
  56. ALL WARRANTIES AND CONDITIONS, INCLUDING WITHOUT LIMITATION THE 
  57. IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR 
  58. PURPOSE, AND NON-INFRINGEMENT.  The entire risk as to the quality 
  59. and performance of  the Software is borne by you. Should the 
  60. Software prove defective, you and not Iterated assume the entire 
  61. cost of any service and repair.  This  Disclaimer of Warranty 
  62. constitutes an essential part of the License Agreement.  SOME 
  63. STATES DO NOT ALLOW EXCLUSIONS OF AN IMPLIED WARRANTY, SO THIS 
  64. DISCLAIMER MAY NOT APPLY TO YOU AND YOU MAY HAVE OTHER LEGAL RIGHTS 
  65. THAT VARY FROM STATE TO STATE OR BY JURISDICTION.

  67. LIMITATION OF LIABILITY: UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL 
  68. THEORY, WHETHER TORT, CONTRACT, OR OTHERWISE, SHALL ITERATED OR 
  69. ITS SUPPLIERS, LICENSORS OR RESELLERS BE LIABLE TO YOU OR ANY OTHER 
  70. PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL 
  71. DAMAGES OF ANY TYPE INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS 
  72. OF GOODWILL, WORK  STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, LOSS 
  73. OF DATA, OR ANY AND ALL  OTHER COMMERCIAL DAMAGES OR LOSSES. IN NO 
  74. EVENT WILL ITERATED BE LIABLE  FOR ANY DAMAGES IN EXCESS OF 
  75. ITERATED'S LIST PRICE LICENSEE FEE FOR THE  SOFTWARE, IF ANY, EVEN 
  76. IF ITERATED SHALL HAVE BEEN INFORMED OF THE  POSSIBILITY OF SUCH 
  77. DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.  SOME  STATES DO NOT
  78. ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL 
  79. DAMAGES, SO THIS LIMITATION AND EXCLUSION MAY NOT APPLY TO  YOU. 
  80.  
  81. TITLE: Title, ownership rights, and intellectual property rights in 
  82. and to the Software shall remain in Iterated and/or its licensors or
  83. suppliers. The Software is protected by copyright laws of the United 
  84. States and international copyright treaties.  You are permitted to 
  85. use only one copy of the Software, even if you receive multiple 
  86. copies, whether via download or on magnetic media.  Title, ownership 
  87. rights, and  intellectual property rights in and to the content 
  88. accessed through the Software is the property of the applicable 
  89. content owner, and may be protected by copyright or other applicable
  90. law.  This License gives you  no rights to such content. 
  91.  
  92. TERMINATION: This License will terminate automatically if you fail to 
  93. comply with the limitations described above.  On termination, you 
  94. must destroy all copies of the Software and documentation. 
  95.  
  96. MISCELLANEOUS: This Agreement represents the complete agreement 
  97. concerning this license between the parties and supersedes all prior
  98. agreements and representations  between the parties.  This Agreement 
  99. may be amended only by a writing executed by both parties.  
  100. THE ACCEPTANCE OF ANY PURCHASE ORDER PLACED BY YOU IS EXPRESSLY MADE 
  101. CONDITIONAL ON YOUR ASSENT TO THE TERMS SET FORTH HEREIN, AND NOT 
  102. THOSE CONTAINED IN YOUR PURCHASE ORDER.  If any provision
  103. of this Agreement is held to be unenforceable for any reason, such 
  104. provision shall be reformed only to the extent necessary to make it 
  105. enforceable.  This Agreement shall be governed by and construed under 
  106. Georgia substantive law as such applies to agreements between Georgia 
  107. residents entered into and performed within Georgia, except as 
  108. governed by United States Federal law.  You consent to the 
  109. jurisdiction of the state and federal courts in the State of Georgia,
  110. U.S.A. The application of the United  Nations Convention on Contracts 
  111. for the International Sale of Goods is expressly excluded. 
  112.  
  113. U.S. GOVERNMENT RESTRICTED RIGHTS: The Software and documentation are 
  114. provided with RESTRICTED RIGHTS.  Use, duplication, or disclosure by 
  115. or  for the U.S. Government is subject to restrictions set forth in 
  116. DFARS  252.227-7013 (c)(1)(ii), FAR 52.227-19, and Clause 
  117. 18-52.227-86(d) of  NASA Supplement to the FAR, as applicable.
